About Uber and Lyft Accidents in St. Louis, Missouri

In general, an auto accident with a rideshare company are not vastly different from a standard car accident. You will have to prove liability, and the at-fault party and their insurance company is responsible for compensating you for your economic damages and non-economic damages, as well as any out-of-pocket expenses and pain and suffering.

However, depending on whether a rideshare accident was caused by an Uber or Lyft driver, there certain differences. Namely, the insurance policy limits, and the fact that you'll be going up against a large corporation instead of just an insurance adjuster. While it is always good to consult with an attorney for an injury claim, quality legal representation is a necessity if the liable party is a large corporation.

What to Do if You Are in an Uber or Lyft Accident in St. Louis

If you're injured in an accident with a rideshare driver, it is important to take the following steps, not only for your health and safety, but for the success of your claim:

  • Check to see if anyone is injured — If anyone is injured, including yourself, the priority is that person's health and safety. Call 911 if necessary, render aid if you can and do not move someone who is severely injured unless they are in danger where they are.
  • Call the police — If you did not need to call an ambulance, call a non-emergency line so the police can come and make a police report, which may include their opinion on who was liable.
  • Gather evidence — Take as many pictures of the damage to both vehicles and the surrounding area as you can. Get the names and contact info of any eyewitnesses. Get the Uber or Lyft ID number of the driver.
  • Report the accident to the rideshare company — The company will have a place to report the accident on their website or app. Even if the rideshare driver was not at fault, you still need to report the accident.
  • Get medical treatment — Even if your injuries are not severe enough to require a trip to a St. Louis emergency room, it is still a good idea to be checked out by a doctor after an accident. Some injuries are not immediately apparent and may be worse than you initially thought.
  • Call Burger Law — While with minor injuries it is not always worth it to get a lawyer for a car accident, do not accept any settlement offer without speaking to an attorney first. At Burger Law, our St. Louis auto accident lawyers review cases for free, and are ready to fight back against a liable party that will not take responsibility for their actions or does not want to pay you.

Who is At-Fault For My Ridesharing Accident in St. Louis, MO

In general, there are three main parties who could be liable for your damages:

The Uber or Lyft Driver

Whether you were a rideshare passenger or were hit while they were driving someone else, a rideshare could be responsible for your injuries through negligence, just as any other driver could be. Uber's insurance policy and Lyft's insurance coverage are almost identical:

  • If the driver was offline and/or the driver app was off, you would hear make a claim against the driver's personal insurance company.
  • If the app was on, and the driver was available or waiting for a ride request, the coverage is:
    • $50,000 in bodily injury per person
    • $100,000 in bodily injury per accident
    • $25,000 in property damage per accident
  • If the driver was on their way to pick up a passenger, or was in the middle of a trip, there is a $1,000,000 policy limit for damage caused to a third party, i.e. not the driver.

The extra insurance coverage if the driver was in the middle of a trip is key if your accident results in catastrophic injuries.

Another Driver

According to Uber's US Safety Report, the accident rate for their drivers per mile is about half the national average. So, it's very likely that a non-rideshare driver is responsible for your injuries. If another driver caused the accident, you would make a claim against their insurance policy just as you normally would.

The Ridesharing Company

Missouri House Bill No. 130, enacted in 2017 to create limited regulations for "transportion network companies" like Uber and Lyft, requires them to conduct background checks on all of their drivers, and require those drivers to have vehicle liability insurance. If they allow someone to drive for them who did not pass a background check, or you were hit by a driver off duty who did not have insurance, you may be able to hold them liable for your damages.
