Do I Have to Talk to the Insurance Company Before I Talk to a Lawyer?

Do you have to talk to the Insurance Company before you speak to your Lawyer?

Insurance companies are out to make a profit. You pay them monthly for coverage, and they hope(and you do too) that you never get into an accident so that they aren't required to actually act on the service you pay for. When an accident does happen, they are going to try to give you the absolute minimum in terms of payout and recovery. This is their business model. So naturally, when you call in to report an accident, they are going to grill you and find ways to either place part of the blame of the accident on you, or find ways to deny you coverage. So the question is, should you talk to your insurance provider or the other person's insurance provider before speaking with a lawyer?

The short answer is no. Always talk to you lawyer first. The only person you are actually required to talk to is the police officer that reports to the accident. Give them a truthful account of what happen during the accident, you're required to by law. Other than that, you're not required to make an immediate statement to your insurance provider.

You may be thinking, but what if I need a new vehicle because mine was totaled, and the only way to get a rental is to have the insurance pay for it. You would be right, however, speaking with your lawyer first is still more important. Your lawyer can help you prepare a statement that you can give to the insurance company which is going to protect you from their tactics. Once the insurance company knows that you have a lawyer representing you, a lot of their tactics are going to be a waste and they won't bother using them on you. Insurance companies know that lawyers know the law, and that lawyers know what you are entitled to receive and at what levels. Talking to a lawyer and having them help you prepare a statement is only going to improve your case and your position.
