On August 28, 2023, the "Siddens Bening Hands Free" law went into effect in Missouri, banning cell phone use for drivers. Until the new law, only drivers 21 years old or younger were prohibited from using cell phones. Under the law, all drivers are prohibited from:

  • Physically holding or supporting a cell phone with any part of their body
  • Manually typing, writing, sending or reading text messages
  • Recording, posting, sending or broadcasting video
  • Participating in video calls or social media posts
  • Watching a video or movie

In Illinois, under 625 ILCS 5/12-610.2, no one can use an "electronic communication device," such as a hand-held cell phone or laptop, while driving. This includes both texting and talking on the phone. There are exceptions for GPS devices, talking on the phone through bluetooth or hands-free devices and emergency situations.

Under the doctrine of negligence per se, if someone is ticketed for texting and driving for the accident that injured you, that person is presumed to be negligent and automatically liable for your injuries.
